Refund & Return Policy (Hedonism Gallery)
1. General Terms
At Hedonism Gallery, we aim to provide accurate descriptions, high-resolution imagery, and detailed condition information to ensure collectors can make informed decisions prior to purchase.
Except where required by applicable law, all sales are considered final.
Buyers are strongly encouraged to review all photographs, descriptions, dimensions, provenance details, and condition reports before completing a purchase.
2. Authenticity & Condition Guarantee
We guarantee the authenticity and material integrity of all items offered for sale.
If an item arrives materially misdescribed or damaged in transit, we will review the claim and, at our sole discretion, offer one of the following remedies:
- repair (if applicable),
- replacement (if available),
- partial refund,
- or full refund.
All claims must be submitted within five (5) calendar days of delivery and must include:
- photographs of the item,
- photographs of all packaging,
- shipping label,
- and clear evidence of damage or misdescription.
Failure to provide sufficient documentation may result in denial of the claim.
3. Original Works (Unique Artworks)
Original, one-of-a-kind artworks are sold on a final-sale basis and are not eligible for return or exchange, except where required by applicable law or in cases of verified material misrepresentation or transit damage.
4. Lithographs, Prints, and Fine Art Editions
Lithographs, etchings, engravings, screenprints, and other fine art editions are sold as collectible works.
Returns are accepted only in cases of:
- material misdescription,
- verified transit damage,
- or where required by applicable consumer protection laws.
Any approved return must include:
- the artwork,
- all original documentation,
- Certificate of Authenticity (if issued),
- and original packaging where reasonably available.
Returned items must be received in the same condition as originally delivered.
We reserve the right to refuse or adjust refunds where items are returned altered, handled beyond reasonable inspection, framed, mounted, restored, or damaged.
All approved returns must be shipped with tracking and, where applicable, insurance for declared value.
5. Posthumous Works and Posters
Posthumous works, exhibition posters, and officially licensed reproductions are sold as described.
Returns are accepted only in cases of material misdescription or transit damage.
Returns based on change of mind, subjective expectations, or buyer preference are not accepted.
6. Collectible Items (Art Toys, Figures, Limited Editions)
Collectible items are eligible for return only if:
- they remain unopened and factory sealed,
- all packaging, shrink-wrap, seals, and accessories are intact,
- and the return request is submitted within fourteen (14) days of delivery.
Opened or tampered items are not eligible for return, except in cases of manufacturing defect, material misdescription, or transit damage.
Return shipping costs are the responsibility of the buyer unless otherwise required by law or agreed in writing.
7. Antique and Rare Books
Due to their age and fragile nature, antique books, rare books, and catalogues raisonnés are sold on a final-sale basis.
Returns are accepted only in cases of material misdescription or verified transit damage.
Claims must be submitted within five (5) calendar days of delivery with supporting photographic evidence.
8. Unclaimed, Refused, or Undeliverable Shipments
If a shipment is returned due to:
- refusal of delivery,
- failure to pay customs duties or taxes,
- incorrect or incomplete address,
- or failure to collect from carrier,
the order will not be eligible for a full refund.
Any eligible refund will be issued minus:
- original shipping costs,
- return shipping costs,
- customs duties, taxes, and storage fees,
- payment processing fees (where non-recoverable),
- and a 15% administrative restocking fee.
9. European Union Right of Withdrawal
Where required by applicable EU consumer protection laws, eligible buyers may exercise their statutory right of withdrawal within fourteen (14) days of delivery.
This right does not apply to goods exempt under applicable law, including unique artworks and other non-withdrawable categories.
Where applicable, refunds include the cost of standard outbound shipping to the buyer.
Return shipping, insurance, customs duties, and import taxes remain the responsibility of the buyer unless otherwise required by law.
To exercise this right, buyers may contact us at art@hedonism.gallery to request a withdrawal form or submit a written cancellation notice.
10. Shipping, Insurance, and Delivery
All items are carefully packaged and shipped using reputable carriers.
Delivery dates are estimates only and not guaranteed.
We are not responsible for delays caused by carriers, customs authorities, or events beyond our reasonable control, including force majeure.
Orders may require tracking and/or signature confirmation upon delivery.
Import duties, VAT, customs charges, and local taxes are the responsibility of the buyer.
Unless otherwise agreed in writing, shipping insurance may be included at the gallery’s discretion or arranged upon buyer request.
11. Fraud Prevention & Abuse Protection
The gallery reserves the right to refuse refunds or investigate claims where there is reasonable suspicion of fraud, abuse, or misuse of the return policy.
This includes but is not limited to:
- claims submitted without sufficient evidence,
- repeated return requests,
- evidence of item alteration or misuse,
- or inconsistent reporting of damage.
