Hedonism Gallery — Refund & Return Policy
1. General Terms
• All acquisitions made through our gallery are considered final.
• Every item is described accurately, with supporting documentation where applicable.
• We encourage collectors to review all descriptions, photographs, and documentation before purchase.
2. Condition and Integrity Guarantee
• We guarantee the integrity of each item.
• If an item arrives damaged or materially misdescribed, we will arrange an appropriate resolution — repair, replacement (if possible), or refund.
• Claims for damage or misdescription must be submitted in writing within 5 days of receipt, with photographic evidence.
3. Original Works (Unique Artworks)
• Original, one-of-a-kind works of art cannot be returned except in cases of damage or misrepresentation.
• These works are unique, and any return for other reasons would result in permanent loss of value.
4. Lithographs and Lifetime Licensed Prints
• Certificate of Authenticity (COA) is issued upon buyer request at the time of sale.
• Returns are accepted only if the buyer requested a COA and returns the work with the COA and all original documentation in the same condition as delivered.
• If COA was not requested, the item may only be returned in cases of damage or misrepresentation.
• All returns must be shipped fully insured via a carrier approved by the gallery.
• The gallery reserves the right to refuse refunds for items returned in altered or damaged condition, or without required documentation.
5. Posthumous Works and Posters
• Posthumous works (e.g., posters created after the artist’s death) are sold as officially licensed reproductions.
• Returns are accepted only if the item arrived damaged or materially misdescribed.
• Returns “just because” the buyer changed their mind are not accepted.
6. Collectible Items (Toys, Figures, Limited Edition Books, etc.)
• Collectible items are eligible for return only if returned unopened, factory-sealed, with all original packaging and accessories intact.
• If the box, shrink-wrap, tamper-evident seal, or packaging has been opened or shows signs of tampering, the item is not eligible for a refund, except in cases of damage or misdescription.
• Returns must be initiated within 14 days of receipt, with written notice and photographic evidence of the received item.
• All returns must be fully insured with tracking and signature. Return shipping is the buyer’s responsibility unless the item was damaged or misdescribed.
7. Antique and Rare Books (100+ Years, Catalogues-Raisonnés, Non-Limited Editions)
• Due to their historical and collectible nature, antique and rare books cannot be returned except in cases of damage during shipment or material misdescription.
• Buyers are strongly encouraged to review all photographs, descriptions, and condition notes prior to purchase.
• Claims must be submitted within 5 days of receipt, with photographic evidence.
• Returns must be fully insured and arranged with gallery approval. Refunds are issued only after verification of the claim.
8. Unclaimed, Refused, or Undeliverable Shipments
• If a shipment is not collected, refused, or returned due to inaccurate delivery info, unpaid customs, or buyer’s failure to complete collection, the order is considered abandoned.
• No refund will be issued in such cases.
• Reshipment requires prepayment of all additional shipping, customs, and administrative costs.
9. European Union — 14-Day Right of Withdrawal
• For EU deliveries, statutory 14-day withdrawal rights apply only to eligible items, primarily lithographs and lifetime licensed prints where COA was requested.
• Returned items must remain in pristine condition with documentation, and shipped fully insured at the collector’s expense.
• Failure to collect or accept delivery does not constitute valid exercise of withdrawal rights.
• Refunds under this right exclude shipping, insurance, and customs costs.
10. Shipping, Insurance, and Risk
• The gallery is not responsible for delays, non-delivery, or loss due to circumstances beyond our control (customs, carrier, force majeure).
• Risk passes to the buyer once the item is handed to the carrier in good condition, unless otherwise agreed in writing.
